These Terms of Service govern your use of the website at venusnailspa-lg.com, your booking of a salon sitting with VENUS NAIL SPA LLC and any arrangement for computer integrated systems design work agreed with the systems desk. They form a single agreement between you and VENUS NAIL SPA LLC.
Please read these terms in full before you book a sitting or send a project request. By using the website, booking a sitting, arriving at the salon or engaging the systems desk, you accept these terms. If you do not accept them, please do not use the website and do not book a sitting. You may still come to the salon desk in person and ask for a printed copy before deciding.
The salon operates from 654 N Santa Cruz Ave, Los Gatos - 95030-4360, United States (US). The desk can be reached by telephone at +14849009957 and by email at appointments@venusnailspa-lg.com. When these terms refer to we, us or our, they mean VENUS NAIL SPA LLC.
1. The agreement
These terms replace any earlier understanding about the website, the salon and the design desk, whether spoken or written. A written quotation or project schedule issued by the systems desk may add to these terms, and if a quoted schedule conflicts with a clause here, the quoted schedule applies to that project and only to that project.
The website is provided for information. A page on this site is not a binding quotation for salon care and it is not a promise that a particular station will be free at a particular moment. Only a confirmation from the desk, whether by telephone or by written message, creates a booked sitting.
If any part of these terms is found to be unenforceable, the rest stays in force. The unenforceable part will be read down to the smallest change that makes it valid, or removed if that is not possible, without affecting the remaining clauses.
2. Eligibility and capacity
You may use this website and book a sitting if you are at least eighteen years of age and able to enter a contract. If you are younger than eighteen, a parent or guardian must make the booking and remain responsible for the sitting, the payment and any care note.
A business that engages the systems desk confirms that the person sending the request is authorised to act for that business. We may ask for written confirmation of authority before a project begins, and we may decline a project where authority cannot be shown.
We reserve the right to refuse service to a person who repeatedly breaches these terms, who behaves abusively toward staff or guests, or who provides false details to the desk. A refusal will be explained in plain language and, where a booking is already paid, the unused part will be returned under section 9.
3. Use of the website
You may read, print and share these pages for your own personal use. You may link to any page on the site. You may not copy substantial parts of the text or the design into another website, you may not frame the site inside another service and you may not present our pages as your own.
The site is served as it stands. We aim to keep it online and correct, but we do not promise that every page will load, that every link will resolve or that the wording will never change. If you find an error, tell the desk and we will correct it as soon as we can.
You must not attempt to gain access to a part of the site that is not public, to overload the server with automated requests, to introduce malicious code or to probe for a weakness without our written permission. If you believe you have found a weakness, write to appointments@venusnailspa-lg.com and give us a reasonable chance to fix it before you publish anything.
4. Booking a sitting
A booking is made when the desk confirms a card on the reception rail. The card records your name, the service, the date and time and the station assigned to you. You should check the card details when you receive the confirmation and tell the desk at once if something is wrong.
A booking reserves a station, not a person. If the staff member you expected is unavailable, another trained member will run the sitting under the same care standard. If no trained member is available, we will offer a new time or a full refund of any amount already paid.
Requests sent through the contact form are enquiries, not bookings. The desk replies to a written request during opening hours and confirms the time separately. Until that confirmation arrives, please treat the time as unbooked.
5. Arrival and late arrival
Please arrive a few minutes before your card is due so that the station can be reset and a fresh towel laid. If you arrive late, the desk will keep the station open for a grace period of about ten minutes. After that, the card may be moved to a walk-in slot and the sitting may be shortened to protect the guests who booked after you.
If you arrive more than twenty minutes late and the station cannot be held, the sitting may be treated as a no show under section 6. Where the delay was caused by something outside your control, tell the desk and the case will be reviewed with care.
If the salon is delayed because a previous sitting ran long, you will be told at the doorway or by telephone if you have not yet arrived. You may wait on the bench, accept a new time or cancel without charge.
6. Cancellation and no shows
You may cancel or move a booking by telephone on +14849009957 or by email to appointments@venusnailspa-lg.com. A move made at least twenty four hours before the sitting is free. A move made within twenty four hours is permitted once per guest. Repeated late moves may result in a request for a deposit for future sittings.
A no show is a sitting where you do not arrive and do not contact the desk within the grace period. The desk will contact you once, then close the card. A first no show is not penalised beyond the lost slot. A second no show within three months may lead to a deposit requirement for the next booking.
Where a deposit has already been paid and you cancel with more than twenty four hours notice, the deposit is returned in full or held against a new sitting, as you prefer. Where you cancel within twenty four hours, the deposit may be held to cover the staff time that was set aside, though the desk will assess each case on its facts.
7. Scope of salon services
The salon offers six services described on the services page: Service Menu Bays, Appointment Card Runs, Care Note Desks, Polish Change Windows, Gel Review Rounds and Walk-in Sittings. Each service is run at a manicure station by a trained staff member and each has a listing card that sets out what is included.
A sitting covers the steps described on its card and nothing more. If a nail is found to be split or weak in a way that needs a longer repair, the desk will explain the extra step and its cost before the work continues. We will not add an unrequested treatment to a sitting.
Nail care is not a medical service. We do not diagnose a skin or nail condition, we do not prescribe a treatment and we do not claim to cure a health problem. If a guest has a condition that concerns them, we will suggest that they seek advice from a qualified health professional rather than proceed without it.
8. Health, allergies and disclosures
Please tell the desk before the sitting if you have a known allergy to a product, a sensitive skin condition, an open cut on the hand, a recent injury or a medical device that may be affected by a lamp. The staff will adjust the tools, the products or the sitting type where they can, or advise you to wait.
A patch test is available on request for a guest who has reacted to a coat before. The test is performed on a small area of skin before a full application and the result is written onto the care record so that the next sitting starts with that knowledge.
Our staff use single use towels and cover the tool tray between guests. Where a guest sees a tool that looks unclean, please tell the desk at once. The tool will be replaced before the sitting continues, and the station will be reset under the supervision of the desk manager.
9. Pricing and payment
Prices are shown on the listing cards at the salon desk and in the current menu that the desk keeps behind the bench. The website describes the services and their general time, but it is not a live price board. A price quoted over the telephone or in a written message is valid for the sitting it refers to.
Payment is taken at the station or at the desk at the end of the sitting, in the way the desk confirms to you. A deposit may be requested for a longer sitting, for a first time booking with a new guest or for a guest who has missed a sitting before. The deposit is applied to the final amount and is not a separate fee.
If a service cannot be completed for a reason within our control, we will discuss a fair adjustment with you before you leave. If a service cannot be completed because the nail type, the condition of the hand or a prior coat makes the requested finish unsafe, no charge will be made for the unfinished part. Tips are optional and are not required for any service.
10. Systems design engagements
The systems desk provides computer integrated systems design work, chiefly booking forms, care note forms, stock trackers and small workflow tools for salons. An engagement begins when a written scope is agreed and any agreed first payment has cleared. Until then, a proposal is an invitation to negotiate and not a binding commitment.
A written scope describes what will be built, the milestones, the assumptions, the client responsibilities and the fee. A change to the scope must be agreed in writing before it is started. We will not begin unrequested work and we will not submit an extra invoice for work that was never agreed.
The client must give timely access to the information, the decision makers and any third party accounts needed to build and test the work. A delay caused by a client responsibility may move the schedule by the same number of days without liability on our side, provided that we tell the client promptly.
11. Deliverables and acceptance
Each deliverable, such as a form, a tracker or a documentation page, is tested against the acceptance points in the written scope. The client has a review period of ten business days after delivery to raise a defect that does not meet an acceptance point. A defect reported inside that period is fixed at no extra charge.
A deliverable is accepted when the client confirms acceptance in writing, or when the review period ends without a reported defect against an acceptance point. A request for a new feature after acceptance is handled as a new engagement or as an agreed change, not as an open defect.
On final acceptance and payment, we hand over the working files, the credentials needed to operate the deliverable and a short written note describing how the build is maintained. Where a hosting provider is part of the build, the account is placed in the client name wherever the provider allows it.
12. Intellectual property
The text, layout, drawing and code of this website belong to VENUS NAIL SPA LLC. The name VENUS NAIL SPA LLC, the station row design and the appointment card device are our property. You may not copy them into another site or use them to suggest an endorsement that we have not given.
For a design engagement, the client owns the content that the client supplies and the final deliverable that is paid for. We retain ownership of the underlying templates, generic components and know how that we bring to the project. The client receives a perpetual licence to use those components as part of the delivered build, and only as part of it.
A third party library used inside a build stays under its own licence. We list each library and its licence in the handover note. The client must keep the licence notice attached to the build, as that licence requires.
13. Content you send us
You keep ownership of the message, the photographs and the information you send to the desk. By sending them, you give us permission to use them for the purpose of answering you, running the sitting or completing a design engagement, and for no other purpose.
Please do not send us information that belongs to another person without that person having agreed. If a photograph shows another person, confirm that you have their permission before you send it. We will remove a photo from our records if the person shown asks us to do so.
Do not send confidential documents, account credentials or government identifiers by email or through the contact form. If a project needs a shared account, we will set up a secure way to transfer the access details.
14. Acceptable use
You agree not to use the website or the salon to harass a staff member or another guest, to send abusive or threatening messages, to attempt fraud, to record staff without consent or to disrupt the salon floor.
You agree not to copy the site for a competing service, to scrape its pages in bulk, to reverse engineer a hosted form that we operate for another salon, or to use our contact form to send unsolicited marketing.
If a message or an action breaches this section, we may stop replying, remove the message, refuse a future booking or end a design engagement. Where the breach causes a loss, the breaching party may be responsible for that loss under section 17.
15. Third party services
The website and the design desk rely on third party services such as a hosting provider and an email provider. Those services have their own terms and their own availability. We choose providers with care but we do not control their servers and we cannot promise that they will never fail.
A link from this site to another business, a map or a directory does not mean that we endorse that business. If you deal with a third party, the contract is between you and that party. We are not responsible for the quality of a product or a service that a third party supplies.
16. Disclaimers
The website is provided as it stands and as it is available. To the extent allowed by law, we make no warranty that the site will be uninterrupted, that it will be free of error or that a page will remain unchanged. We do not warrant that a result from a design build will produce a particular business outcome.
Nail care results differ from person to person. A coat that lasts well for one guest may lift sooner for another because of nail type, hand care or daily work. We will work to the care standard we describe and we will repair a defect within the period stated on the card, but we cannot promise that every finish will last an identical number of days.
Nothing in these terms removes a warranty or a right that the law gives you and that cannot be excluded by agreement. Where a clause here conflicts with such a right, the right prevails.
17. Limitation of liability
To the extent allowed by law, VENUS NAIL SPA LLC is not liable for an indirect loss, a lost profit, a lost business opportunity or a loss that was not reasonably foreseeable when the booking or the engagement was made.
For a salon sitting, our total liability for a claim arising from that sitting is limited to the price of the sitting concerned. For a design engagement, our total liability is limited to the fee paid for the deliverable that gave rise to the claim. This limit does not apply to a loss caused by our wilful misconduct, to a personal injury caused by our negligence, or to any liability that the law does not allow us to limit.
We are not liable for a loss caused by a delay or a failure that is outside our reasonable control, such as a power cut, a severe weather event, a network outage at a provider, a public health order or a labour action. If such an event stops a sitting or a milestone, we will offer a new time or a fair adjustment.
18. Indemnity
You agree to cover VENUS NAIL SPA LLC for a loss, a claim or a reasonable legal cost that arises from your breach of these terms, from content that you send that infringes another person right, or from your misuse of the website or of a delivered system.
This obligation does not apply where the loss was caused by our own fault or by a failure on our side. If a claim is brought, we will tell you promptly, we will give you the information you reasonably need and we will allow you to take part in the defence. We will not settle a claim in a way that admits your fault without your agreement.
19. Privacy
Our Privacy Policy explains how we collect, use and protect personal information. It forms part of these terms. You can read it on the Privacy Policy page. Where these terms and the Privacy Policy touch the same subject, the Privacy Policy controls the handling of personal information and these terms control the commercial arrangement.
For a design engagement that handles the records of another salon guests, the client remains responsible for its own privacy notices and consents. We handle those records only on the written instruction of the client and we do not use them for our own purposes.
20. Suspension and termination
We may suspend or end your use of the website or the salon if you breach these terms and do not correct the breach within a reasonable time after we tell you. For a serious breach, such as abuse of staff or fraud, we may end access at once.
Either party may end a design engagement by written notice. If the client ends the engagement, the client pays for the work completed and for any non refundable cost already committed at the date of notice. If we end the engagement for a reason other than a client breach, we return any amount paid for work not yet done and we hand over the work completed so far.
Clauses that by their nature should survive the end of the agreement, including intellectual property, confidentiality, liability and governing law, continue to apply after the engagement closes.
21. Changes to these terms
We may update these terms to reflect a change in the salon, a new service or a change in the law. The effective date at the top of the page shows the current version. Where a change is significant, we will place a clear notice on the website before it takes effect and we will give a booked guest a reasonable chance to read it.
A change does not alter a sitting that is already booked under an earlier version, unless the change is required by law or is needed for safety. A design engagement is governed by the version of these terms that was in force when the written scope was agreed.
The desk keeps a copy of each past version. A guest or a client may ask for the version that applied to their booking or project, and the desk will supply it.
22. Governing law and disputes
These terms are governed by the law of the State of California, United States, without regard to a conflict of laws rule that would point to another jurisdiction. The state and federal courts located in California have exclusive jurisdiction over a dispute that cannot be settled between the parties.
Before a formal claim is filed, we ask both parties to try to resolve the matter directly. Write to the desk with a clear description of the issue and the outcome you seek. We will reply within fourteen days and we will try to reach a fair resolution without a formal process.
Where a consumer protection law in your home country gives you a right to bring a claim in your own courts, that right remains. Nothing in this section removes a protection that the law gives you and that cannot be waived.
23. General provisions
These terms and any written scope or booking confirmation form the whole agreement between you and VENUS NAIL SPA LLC on their subject. A failure to enforce a clause on one occasion is not a waiver of that clause on another occasion.
You may not transfer your rights under these terms to another person without our written agreement. We may transfer our rights to a successor business if VENUS NAIL SPA LLC is sold or restructured, provided that the successor accepts these terms.
A notice to us may be sent by email to appointments@venusnailspa-lg.com or by post to 654 N Santa Cruz Ave, Los Gatos - 95030-4360, United States (US). A notice to you is sent to the email address or the postal address that you gave the desk, and it is treated as received on the next business day after it is sent.
24. Contact details
